1. Who We Are and What This Policy Covers
TR Design Studio ("TRDesign", "we", "us", or "our") is based in Morocco and sells digital mockup templates, including Photoshop (PSD) files, through https://trdesign.studio/ and its associated storefront at https://shop.trdesign.studio/ (together, the "Website"). We are responsible for the personal data described in this Privacy Policy.
This Privacy Policy explains what personal data we collect, why we collect it, who we share it with, how long we keep it, and what choices you have. It applies when you visit the Website, download a free mockup, buy a mockup, subscribe to our newsletter, send us a message, or ask us for a custom mockup. It should be read together with our Terms & Conditions and the TRDesign License Agreement.
By using the Website, you confirm that you have read this Privacy Policy. If you do not agree with it, please do not use the Website.
2. Key Terms
- Personal data: any information that identifies you or can be used to identify you, such as your name, email address, or IP address.
- Payment Provider: the third-party service that processes payments on our storefront, currently Blink, which uses Stripe.
- Cookie: a small file stored by your browser that helps a website work, remember your choices, or measure usage.
- Service providers: companies that process personal data on our behalf, such as hosting, payment, and email services.
3. Personal Data We Collect
Data you give us
- Orders and downloads: your email address, and your name and billing details if the checkout asks for them, so that we can deliver your files and receipts.
- Contact and support messages: your name, email address, and the content of your message and any files you send.
- Custom mockup requests: your name, email address, project details, and files or references you send through the Request Mockup form or by email.
- Newsletter: your email address when you subscribe.
Data collected automatically
- Technical data such as your IP address, browser and device type, language, pages viewed, referring page, and approximate location derived from your IP address, collected through cookies and similar technologies (see Section 9).
Payment data
Payments are handled by our Payment Provider. Your card or other payment details are entered on the Payment Provider's checkout and are processed by it and its payment processor. We do not receive or store your full card details. We receive order information such as the product purchased, the amount, the date, and your email address.
We do not knowingly collect sensitive personal data, and we ask you not to send it to us.
4. How We Use Your Data
We use personal data to:
- Deliver your downloads and purchases, send receipts, and let you re-download paid files.
- Process payments, taxes, refunds, and prevent fraud, together with our Payment Provider.
- Reply to your messages, support requests, and custom mockup requests.
- Send you our newsletter and promotions, only if you subscribed, and always with an unsubscribe link.
- Send you messages about your order, such as receipts, download links, and, where our Payment Provider offers it, a reminder if you leave a checkout unfinished.
- Understand how the Website is used and improve it.
- Protect the Website, enforce our Terms & Conditions and License Agreement, and comply with legal obligations.
If you are in the European Economic Area or the United Kingdom, our legal bases are: performing our contract with you (orders and downloads), your consent (newsletter, non-essential cookies), our legitimate interests (security, fraud prevention, improving the Website, answering your requests), and legal obligations (accounting and tax).
5. Who We Share Data With
We do not sell your personal data. We share it only as needed with:
- Our Payment Provider (Blink) and its payment processor (Stripe), to process payments, calculate taxes, prevent fraud, and deliver files and receipts. They act under their own terms and privacy policies.
- Website platform and hosting providers, which run the Website.
- Email and newsletter providers, which send our messages.
- Analytics providers, if we use them (see Section 9).
- Authorities and advisors, when the law requires it, to respond to legal claims, to protect our rights, or to prevent illegal activity.
- A buyer or successor, if TRDesign is sold, merged, or reorganized, provided the new owner respects this Privacy Policy.
Service providers may only use your data to provide their services to us or, for our Payment Provider, as described in its own policies.
6. International Transfers
TRDesign is based in Morocco, and our service providers may process data in other countries, including the United States and countries in Europe. These countries may have different data protection laws than yours. Where required, we rely on appropriate safeguards, such as contractual protections offered by our service providers. By using the Website, you understand that your data may be transferred and processed outside your country.
7. How Long We Keep Data
We keep personal data only as long as needed for the purposes in this policy:
- Order and payment records: for the period required by applicable accounting, tax, and legal rules.
- Support and custom request messages: for as long as needed to handle your request and to answer follow-up questions, and for a reasonable period afterward.
- Newsletter: until you unsubscribe.
- Technical and analytics data: for the period set by the tool that collects it.
When we no longer need data and are not required to keep it, we delete it or make it anonymous. Backups may keep copies for a limited time.
8. Security
We use reasonable technical and organizational measures to protect personal data, including encrypted connections (HTTPS) on the Website and a Payment Provider that handles card data on its own secure checkout. No system is completely secure, and we cannot guarantee absolute security. If you believe your data has been compromised, contact us immediately.
9. Cookies and Similar Technologies
We use cookies and similar technologies to make the Website work, to remember your choices, and to understand how the Website is used. Our Payment Provider and its processor may also set cookies on the checkout, for example to keep your session secure and prevent fraud.
- Essential cookies: needed for the Website and checkout to work.
- Analytics cookies: help us see which pages are visited and how the Website performs.
- Advertising cookies: we do not use advertising or remarketing cookies.
We never place personally identifiable information in cookies. You can block or delete cookies in your browser settings, but some features of the Website, including checkout, may stop working properly. Where the law requires your consent for non-essential cookies, we will ask for it.
10. Your Rights and Choices
Depending on where you live, you may have the right to:
- Access the personal data we hold about you and receive a copy.
- Correct data that is inaccurate or incomplete.
- Ask us to delete your data, or to restrict how we use it.
- Object to certain uses, including direct marketing.
- Receive your data in a portable format.
- Withdraw your consent at any time, without affecting what happened before.
To exercise a right, email contact@trdesign.studio. We may need to verify your identity first and will reply within a reasonable time, and within one month where the law requires it. You can unsubscribe from our newsletter at any time using the link in each email. We may keep some information when the law or a legitimate interest requires it, for example order records for accounting.
If you are in Morocco, your rights are set by Law No. 09-08 on the protection of individuals with regard to the processing of personal data, and you can contact the Moroccan data protection authority, the CNDP. If you are in the European Economic Area or the United Kingdom, you can also complain to your local data protection authority.
California residents. You may ask what personal information we collect and use, ask us to delete or correct it, and you will not be treated differently for exercising these rights. We do not sell or share personal information for cross-context advertising. Contact us to make a request.
11. Children
The Website is not directed to children under 16, and we do not knowingly collect personal data from them. If you are a parent or guardian and believe your child has given us personal data, contact us and we will delete it.
12. Links to Other Websites and Third-Party Services
The Website may link to other websites and services, including our social media pages and our Payment Provider. We do not control them and this Privacy Policy does not apply to them. Please read their own privacy policies before giving them your data.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The revised version will be published on this page with an updated revision date. If a change is material, we will give notice, for example on the Website or by email, before it takes effect. By continuing to use the Website after the changes take effect, you accept the revised policy.
14. Governing Law
This Privacy Policy is governed by the laws of the Kingdom of Morocco, without regard to conflict of law rules. This does not remove any mandatory data protection rights that apply to you under the laws of the country where you live.
