1. Agreement to These Terms

These Terms & Conditions (the "Terms") are a contract between you and TR Design Studio ("TRDesign", "we", "us", or "our"). They apply to your use of https://trdesign.studio/ and its associated storefront at https://shop.trdesign.studio/ (together, the "Website"), to every download or purchase you make, and to any email or other communication between you and us.

By visiting the Website, downloading a free mockup, placing an order, or contacting us, you confirm that you have read these Terms and agree to be bound by them, together with our Privacy Policy and the TRDesign License Agreement. If you do not agree, please do not use the Website. "You" means you as an individual and any business or organization you represent.

2. Definitions

• Mockup: a digital mockup template or design resource provided by TRDesign, including Photoshop (PSD) files.
• Viewing Angle: one view of a mockup (for example front, back, or side), delivered as its own PSD file and priced individually.
• Free Mockup: a mockup offered at no cost under the Free License.
• Premium Mockup: a paid mockup offered under the Regular License or the Extended License.
• License Agreement: the TRDesign License Agreement published on our Pricing & License page (https://trdesign.studio/pricing-license).
• Payment Provider: the third-party service that processes payments on our storefront, currently Blink, which uses Stripe.
• Country: where TRDesign is based, in this case Morocco.

3. Using the Website

You may browse the Website and download or buy mockups for lawful purposes and in accordance with these Terms. You agree not to:

• Copy, host, sell, rent, lease, distribute, or otherwise commercially exploit the Website or its content, except as the License Agreement allows for mockups.
• Modify, disassemble, decrypt, reverse engineer, or make derivative works of any part of the Website.
• Remove, alter, or obscure copyright, trademark, or ownership notices of TRDesign or its licensors.
• Interfere with the Website's operation, attempt unauthorized access, or use automated tools to scrape or overload it.
• Use the Website in a way that violates any law or the rights of others.

4. Mockup Licenses

Your rights to use any mockup are set out in the License Agreement. TRDesign offers three license levels: the Free License, the Regular License, and the Extended License. The license level that applies to you is the one you obtained when you downloaded or purchased the mockup.

These Terms govern your use of the Website, orders, payments, and everything else that is not about how you may use a mockup. If there is any conflict between these Terms and the License Agreement about how you may use a mockup, the License Agreement prevails. A product listing may add specific restrictions or terms, which apply to the extent that they expressly modify the License Agreement.

A free download or a purchase gives you a license to use the files. It does not transfer ownership of the original files or their intellectual property.

5. Orders, Prices, and Payment

• Premium Mockups are sold per Viewing Angle. The price and license level shown at the time of purchase apply to your order.
• Prices are listed in US dollars. We may change prices or revise our license options at any time, but changes do not affect orders you have already completed.
• Applicable taxes, such as VAT or sales tax, are calculated at checkout based on your location. Depending on the product, the listed price may or may not already include them.
• Payments are processed by our Payment Provider. We do not store your full card details. The Payment Provider may act as the seller of record for payment and tax purposes, and its own terms and privacy policy apply at checkout.
• If your payment is declined, no order is created. Contact your payment method issuer first, then contact us if the problem continues.

6. Digital Delivery and Re-Downloads

Mockups are digital files. After a successful payment or free download, you receive access through the download link or purchase page provided at checkout. No physical product is shipped.

Paid mockups remain available for re-download for as long as TRDesign continues to offer the product or the storefront, as described in the License Agreement. We recommend keeping your own backup copy. We may update, replace, or withdraw a mockup at any time, and we have no obligation to provide updates for files you have already downloaded.

7. Refunds

Because mockups are digital products, purchases are non-refundable, except where you encounter a corrupted file, an unsuccessful download, or a material discrepancy between a product and its description. In those cases, contact contact@trdesign.studio with your order details, and we will provide a working file or a refund, as appropriate.

This policy does not limit any mandatory consumer rights that cannot legally be excluded.

8. Custom Mockup Requests

You may ask us to create a custom mockup through the Request Mockup form or by email. Before work begins, the scope, price, delivery time, number of revisions, and license level for the custom work are agreed in writing, including by email. Any agreement is governed by these Terms and the License Agreement, unless the written agreement states otherwise for a specific point.

9. Intellectual Property

The Website and its content, features, and functionality, including text, images, designs, mockup templates, and the selection and arrangement of them, are owned by TRDesign or its licensors and are protected by Moroccan and international copyright, trademark, and other intellectual property laws.

Except as expressly allowed by the License Agreement or these Terms, you may not copy, modify, reproduce, download, or distribute the Website's material without our prior written permission. Artwork, logos, photographs, and trademarks supplied by third parties may remain the property of their owners, and you are responsible for any additional permissions needed for your use.

10. Feedback and Submissions

Any feedback, comments, ideas, or suggestions you send us about the Website, our mockups, or our services ("Suggestions") are non-confidential, and we may use, copy, modify, publish, or redistribute them for any purpose without credit or compensation to you.

This does not apply to your own finished designs or artwork. You keep ownership of the designs you create with our mockups, subject to the License Agreement.

11. Promotions and Discount Codes

From time to time we may offer promotions or discount codes. They may have separate conditions such as an expiry date, eligible products, or a limit on use, and they cannot be combined or exchanged for cash unless we say so. We may end a promotion at any time.

12. Third-Party Services and Links

The Website may include links to, or content from, third-party websites and services, including our Payment Provider and social platforms. We do not operate or control them and are not responsible for their content, accuracy, availability, or practices. When you leave the Website, these Terms no longer apply, and the third party's own rules and policies apply. You use third-party services at your own risk.

13. Cookies and Privacy

We may use cookies and similar technologies to make the Website work and to understand how it is used. Details about how we collect and use personal data, and your choices, are in our Privacy Policy (https://trdesign.studio/privacy-policy). We never place personally identifiable information in cookies. Most browsers let you disable cookies, but some features of the Website may then not work correctly.

14. Termination

We may suspend or restrict your access to the Website, or end your license under the License Agreement, if you breach these Terms or the License Agreement, with or without prior notice, subject to applicable law and any mandatory rights that cannot legally be excluded. You may stop using the Website at any time.

Termination does not affect rights or remedies that arose before it. If your license ends, you must stop using the affected mockups and delete the Original Files, as defined in the License Agreement.

15. Copyright Infringement Notice

If you are a copyright owner, or are authorized to act for one, and believe that material on the Website infringes your copyright, contact us at contact@trdesign.studio with: (a) your physical or electronic signature; (b) identification of the material you claim is infringing; (c) your contact details, including an email address; (d) a statement that you have a good faith belief that the use is not authorized by the owner, its agent, or the law; and (e) a statement that the information in your notice is accurate and that you are authorized to act on the owner's behalf.

16. Disclaimer and No Warranties

The Website and our mockups are provided "as is" and "as available". To the maximum extent permitted by applicable law, TRDesign disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we do not guarantee that the Website will be uninterrupted or error-free, that files will be compatible with every version of your software, or that the mockups will meet your specific requirements or achieve any particular result.

Price and availability information may change without notice. TRDesign is not responsible for any content, code, or other imprecision in third-party materials. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by applicable law, TRDesign and its suppliers are not liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or business interruption, arising from your use of, or inability to use, the Website or the mockups, even if we have been advised of the possibility of such damages.

Our total liability for any claim relating to the Website or a mockup is limited to the amount you actually paid for the product that gave rise to the claim. For Free Mockups, this amount is zero. Nothing in these Terms limits liability that cannot legally be limited, including mandatory consumer rights.

18. Indemnification

You agree to indemnify and hold TRDesign and its affiliates, officers, employees, agents, partners, and licensors harmless from any claim or demand, including reasonable legal fees, arising from: (a) your use of the Website; (b) your breach of these Terms or the License Agreement; (c) your violation of any law or regulation; or (d) your violation of any right of a third party, including through designs or artwork you create with our mockups.

19. Typographical Errors

If a product is listed at an incorrect price or with incorrect information due to a typographical or technical error, we may refuse or cancel any order for it, whether or not the order has been confirmed. If you have already paid, we will refund the amount charged.

20. Changes to the Website and to These Terms

We may modify, suspend, or discontinue the Website or any feature, temporarily or permanently, with or without notice, and without liability to you, subject to applicable law.

We may update these Terms from time to time. The revised version will be published on this page with an updated revision date. If a change is material, we will give at least 30 days' notice before it takes effect. By continuing to use the Website after the changes take effect, you accept the revised Terms. If you do not agree, you must stop using the Website. Orders you completed before a change are governed by the terms that applied when you ordered.

21. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Morocco, without regard to conflict of law rules. This does not remove any mandatory consumer protection that applies to you under the laws of the country where you live.

If you have a dispute with us, please first send a written notice to contact@trdesign.studio, with your name and contact details, the facts of the dispute, and the outcome you are asking for. We will try to resolve it by good-faith discussion within thirty (30) days. If it is not resolved, the dispute may be brought before the competent courts of Morocco, unless mandatory law gives you the right to bring it elsewhere. Either party may seek urgent protective measures from any competent court to protect its rights or property.

22. General Provisions

• Entire agreement. These Terms, together with the License Agreement, the Privacy Policy, and any other legal notice we publish on the Website, are the entire agreement between you and TRDesign about the Website and replace all prior agreements on the same subject. You may be subject to additional terms for specific purchases, which we will provide at the time.
• Order of precedence. For how you may use a mockup, the License Agreement prevails over these Terms. For everything else, these Terms prevail over any other general terms.
• Severability. If any provision is found to be unenforceable or invalid, it will be interpreted to achieve its purpose as far as possible, and the remaining provisions stay in effect.
• Waiver. Our failure or delay in exercising a right does not waive it. A waiver is effective only in writing.
• Transfer. You may not transfer your rights or obligations under these Terms. We may transfer ours as part of a reorganization or sale of the business.
• Headings. Section headings are for convenience only and have no legal effect.
